VGH Baden-Württemberg Judgment of May 2, 2012, 2 S 2904/10 Reimbursement for orthodontic treatment in adults
Key Points
1. Based on a constitutional interpretation oriented toward the purpose and intent of the regulation, the granting of reimbursement for expenses related to orthodontic treatment in adults may be required in special individual circumstances, even beyond the exceptions specified in Section 1.2.3 (b) of the Annex to the BVO.
2. Such special circumstances may exist when the treatment is exclusively medically indicated and aesthetic reasons can be ruled out, no alternative treatment is available, significant secondary problems exist (e.g., temporomandibular disorder), and a so-called secondary anomaly is present that was acquired only in adulthood .
